Employee Fined Rs 5 Lakh By Gujarat Court For Breaking Notice Period Contract

According to the conditions of her employment contract, she had to give written notice of her intention to resign 30 days before her planned last day of employment

An Ahmedabad local court ruled that an employee's employer could recover Rs 5 lakh from its employee as damages for her abrupt resignation and unexplained absences. 


In this case, Jensen Kobain Solutions Pvt Ltd hired Mariya Rajput as a trainee associate (financial) in February 2021 with a six-month probationary period. Her appointment was confirmed under certain service terms following the conclusion of her probation.


According to the conditions of her employment contract, she had to give written notice of her intention to resign 30 days before her planned last day of employment.


The company sued for breach of contract, alleging that it caused financial losses and harm to its reputation.
Although the employee did not take part in the court proceedings, the court permitted the corporation to recoup the sum via an order issued during an ex parte hearing.
